Thanks to an alert commenter, I note that the 2d circuit's public website now shows that an answer to the judge's show cause order was filed on November 14 as an answer to the FACDL's quo warranto writ.
I'm sorry that I don't now have the text of the answer. I'll look around for it. Appearing for the State is attorney Louis Hubener. I've emailed him to see if he is willing to pass on the text of his reply.

My take on this response is that the state officials admit they called the conflict/regional counsel public defenders for funding but we shouldn't consider that duck that walks and quacks like a duck, a duck. Interesting circular argument - let me know what you think . . .
I´m with you on this. The State´s response seems more like an attempt to argue by saying "because we say so" than to really offer an explanation for why FACDL´s petition is deficient...
If the State succeeds with this response it will be because it´s the State, not because justice is truly on it´s side...
